Current Agreement for Permanent Placements

 

Definitions

This agreement is between A People Recruitment (hereinafter called ‘A People’) and the You the Client Company to whom an introduction of a Candidate is made (hereinafter called ‘the Client’). The Client shall also mean any associated or subsidiary company or any person or legal entity associated with the Client, or any third party to whom the Client passes information relating to the Candidate. The Candidate shall mean the person who is introduced to the Client either at the Client’s request or otherwise. Employment means the utilisation of the Candidate whether paid or unpaid, on a permanent, temporary, or contract basis.

 

Introduction

An introduction shall be deemed to have taken place when any information relating to a Candidate is provided to the Client by A People such introduction to be deemed in force for a period of twelve months from date the introduction is made.

The information submitted to the Client is done so with the strictest of confidence and the Client agrees not to divulge any information to any third party, or to solicit reference information without the express permission of A People. The Client agrees not to approach the Candidate directly, and all communication necessary shall be made through A People at all times.

 

Service and Liability

A People will use its resources to supply interested Candidates to the Client to fulfil the Client’s current job requirement.

Whilst A People will use its best endeavours to ensure that the Candidate is technically and professionally able to satisfy the Client’s requirement, it is the Client’s responsibility to ensure that the Candidate is technically and professionally suitable before an offer of employment is made.

It is also the Client’s responsibility to ensure that the Candidate has the required references, entitlement to work in the EU and level of medical health. A People shall not in any circumstance be liable for any act, omission, error or default of the Candidate.

A People will not be responsible for any loss to the Client whether directly or indirectly as a result of an introduction, offer or employment of the Candidate being made.

 

Fees and Payment

The percentage fee payable to A People is calculated on the Candidate’s annual salary and any guaranteed bonus and agreed benefits at the commencement of employment.

 

Scale of Fees

Up to €29,999                                        18   %

€30,000 – €49,999                              20   %

€50,000 – €69,999                              22.5%

Over €70,000                                       25    %

Preferential Rates are available for volume and exclusive business.

The fees will become payable within fourteen days of the commencement of employment. A People shall charge interest on fees at 3% over the Central Banks lending rate should the agreed payment term not be met.

 

VAT

VAT is payable on all fees at the prevailing rate.

 

Rebates

Should a Candidate leave the employment of the Client a refund will be made to the Client save whereas:

The Client has not accurately informed the Candidate of his/her duties at the time of an offer of employment being accepted.

The Client has failed to fully satisfy themselves of the Candidate’s skills, technical and/or professional, at the time of an offer of employment being made.

The Candidate is made redundant.

The Client fails to notify A People in writing within seven days of the termination.

The fee payable to A People is not met in accordance with the agreement.

The offer of employment is withdrawn without exceptional reason.

The Client has not met the terms and conditions of this agreement.

 

Scale of Rebates

If the Candidate leaves the employment of the client within eight weeks of the commencement of employment, a full refund will be made less 12.5% for each week or part thereof that the Candidate worked including any notice period worked or otherwise.

Written application for refund must be made within fourteen days.

 

Effective and Governing Law

In the event of dispute between A People and the Client, Irish Law will govern this agreement.

These terms and conditions will remain in force for a period of twelve months after the introduction.

 

Sign Off

The Client, whose authorised signatory has previously signed an Agreement for Permanent Recruitment, accept these terms and conditions as outlined above are binding and supercede any previous agreement.
